Moraine is a city in the Dayton Metropolitan area in Montgomery County, Ohio. Mayor’s court in Moraine is held on Wednesdays with designated time slots depending on the purpose of the court visit. The Mayor’s Court schedule is as follows:

Wednesdays:

  • 1:30p.m. – to establish any payment agreements between the parties or the court. For example, to establish a payment plan to pay a traffic citation.
  • 2:30 p.m. – Prisoners arraignments. An arraignment is a formal reading of the charges against an alleged offender.
  • 2:45 p.m. – Trials – mayor’s court hears trials on crimes such as misdemeanors, OVI charges, and traffic offenses.

Moraine Mayor’s Court

The Moraine mayor’s court, while different than the Montgomery County Municipal Court in that it is not as formal, not a court of record and it has limited jurisdiction, still establishes some rules and regulations to be adhered to when entering the courtrooms. Accordingly, the rules of the Moraine Mayor’s Court include the following:

  • With the exception of authorized personnel, including law enforcement officers and probation officers, there are NO Weapons allowed into or near the court;
  • No hats, inappropriate shorts, tank tops, sandals, miniskirts, sunglasses or other inappropriate clothing will be allowed in the court and pants should not fall below the waistline;
  • No offense clothing or language will be allowed in court;
  • All persons entering the court room must wear clean and proper attire as determined by Court personnel;
  • No food, drink, or muddy shoes will be allowed in the court;
  • Distracting or disruptive conduct is prohibited; and
  • Cell phones must be turned off. A $25 fine is paid if a cell phone goes off in court.

Types of Cases in Moraine Mayor’s Court

Offenders, especially traffic offenders, may be cited by the Moraine Police Department or the Montgomery County Sheriff’s Office. Since Mayor’s Courts are run by the Mayor’s office, they only have limited jurisdiction. Thus, mayor courts can only hear misdemeanors, OVI charges, and traffic violations.

  • Traffic Violations – which generally includes the typical moving violations for speeding, failure to stop for a red light, and right of way violations.
  • Operating a Vehicle Under the Influence of Alcohol or Drugs (OVI) – which involve alleged offenders who have been charged with OVI under ORC § 4511.19 or under the Cheviot City Code. OVI charges in Cheviot also include minors being charged with underage drinking.
  • Misdemeanors – which generally involve minor misdemeanors such as public gambling, disorderly conduct, criminal trespass, curfew violations etc…. Mayor’s courts are not authorized to hear certain types of misdemeanor cases such as those involving domestic violence or protective orders.

Since Moraine Mayor’s Court is what is considered a court of record, the defendant does not appeal the case in the traditional sense. If a defendant is unhappy with the result, then he or she may have the case retried in Moraine County Municipal court. The Municipal Court will review the case as if it was the first time the case was brought to a court.

Moraine Mayor’s Court Penalties

The type of consequence that could result from a conviction in the Moraine Mayor court will depend on the classification of the offense charged. The penalties for misdemeanors settled in mayor’s court include the following:

  • First-degree misdemeanor –punishable by up to 180 days in jail and up to $1,000 fines.
  • Second-degree misdemeanor – punishable by up to 90 days in the jail and up to $750 fines.
  • Third-degree misdemeanor – punishable by up to 60 days in jail and up to $500 fines.
  • Fourth-degree misdemeanor – punishable by up to 30 days in jail and up to $250 fines.
  • Minor misdemeanor –no jail time and up to $150 fines.
