Elements of Corruption of a Minor in Ohio

The elements of the criminal offense of corruption of a minor under R.C. 2907.04 include:

  • the defendant is 18 years of age or older;
  • engaged in sexual conduct with another;
  • the other person was not the spouse of the defendant; and
  • the defendant knew that the other person was 13 years of age or older but less than 16 years of age or the defendant was reckless in that regard.

Definitions in Ohio’s Sex Crime Statutes

The standard jury instruction for the sexual offense of corruption of a minor under R.C. 2907.04 can be found at 2 OJI-CR 507.04 and list many of the definitions for words used in the statutory language.

The term “sexual conduct” means vaginal intercourse between a male and female, anal intercourse, fellatio, or cunnilingus, between persons regardless of sex. Under Ohio law, penetration, however slight, is sufficient to complete vaginal intercourse or anal intercourse.
